These Terms of Service (“Terms”) are an agreement between you and Olbrain Labs Private Limited (“Olbrain”, “we”, “us”), a company incorporated in India (CIN U62013HR2024PTC123898) with its registered office at 825-26, Emaar Emerald Plaza, Sector 65, Gurugram, Haryana — 122102. They govern your use of this website (olbrain.com) and the Olbrain platform — Olbrain Studio (studio.olbrain.com), Noesis (noesis.olbrain.com), Screens (screens.olbrain.com), admin.olbrain.com, and the Olbrain Agent API and SDKs (together, the “Services”).
By using the Services you accept these Terms. If you use them on behalf of an organization, you confirm that you are authorized to accept these Terms for it, and “you” includes that organization.
If your organization has signed an agreement with Olbrain — an order form, master services agreement or Data Processing Agreement — that agreement governs your use of the Services and prevails over these Terms wherever the two differ.
You own the data you and your agents bring to the Services — documents, knowledge bases, records, messages and the outputs your agents produce (“Customer Data”). You give Olbrain permission to host, process and transmit Customer Data only as needed to provide, secure and support the Services for you.
We process Customer Data on your behalf and under your instructions, as described in our Privacy Policy, on our Trust & Security page and in any Data Processing Agreement with your organization. Customer data is stored and processed in India (Google Cloud, Mumbai region). We do not use Customer Data to train base models, fine-tunes or evaluations.
You are responsible for having the rights and consents needed for the data you bring, including personal data about your own customers, and for using it lawfully.
You agree not to use the Services, or let others use them, to:
We may investigate suspected misuse and take reasonable steps to stop it, as described in section 10.
Agents can connect to services run by others — for example email, messaging, calendar, storage and commerce platforms. Your use of those services is governed by their own terms, and you are responsible for complying with them. Olbrain is not responsible for third-party services or for changes their providers make.
Olbrain owns the Services, including the software, designs, documentation and the Olbrain name and marks. While you use the Services in line with these Terms, we give you a limited, non-exclusive, non-transferable right to use them for your organization’s internal business purposes. If you send us feedback or suggestions, we may use them without obligation to you.
We keep improving the Services, so features may be added, changed or removed. We will give reasonable notice before removing a feature that your organization pays for. Features labelled preview or beta are offered as they are and may change or end at any time.
We work to keep the Services available, secure and accurate, but to the extent the law allows, the Services are provided “as is” and “as available”, without warranties of any kind beyond those stated in your signed agreement.
To the extent the law allows, neither you nor Olbrain is liable to the other for indirect, incidental, special or consequential losses, or for lost profits, revenue or data. Each party’s total liability arising out of the Services is limited to the fees you paid Olbrain for the Services in the twelve months before the event giving rise to the claim. These limits do not apply to your payment obligations or to liability that cannot be limited by law.
When we change these Terms, we update the date at the top of this page. If a change materially affects paying customers, we will tell your organization’s admins in advance. Continuing to use the Services after a change takes effect means you accept the updated Terms.
